Does Binance report to the German tax office?
The question shifted in 2026. Binance has withdrawn its application for MiCAR authorisation and has been discontinuing its services for users in the EU since 1 July 2026. For your tax return, this does not change the obligation to declare past gains — it only changes how long you will still be able to access the data you need to do so.

What changed on 1 July 2026
Binance withdrew its application for MiCAR authorisation as a crypto-asset service provider with the Greek supervisory authority HCMC on 24 June 2026. Since 1 July 2026, users in the EU can no longer make new purchases, deposits or use staking.
What remains possible are withdrawals and the winding-down of existing positions, so that customers can transfer or sell their holdings. According to its own announcement, Binance informs customers of specific deadlines by email and in the app; the company has stated that it is seeking authorisation in another EU member state.
What has not been publicly promised is how long access to the account — and thus to the transaction history — will remain available. That is where the tax risk lies — not in the reporting obligation.
What this means for your tax return
Tax liability does not depend on whether a provider reports. If you sold or exchanged at a gain via Binance within the holding period in any year, you have to declare it — before the EU withdrawal as after it. The only thing the withdrawal changes is the evidence: without account access there is no export, and without an export the tax bases have to be estimated.
The general rule applies to the reporting obligation under the Crypto-Asset Tax Transparency Act (Kryptowerte-Steuertransparenzgesetz): it applies to crypto-asset service providers that fall within its scope. Which categories these are and from when reports are made is explained on our page on DAC8 and the reporting obligation. We make no statement as to whether Binance specifically reports — that could not be verified from the outside, and the status is currently changing.
In practice, this means: the question “does Binance report?” is secondary for your tax return. The question “do I have my data?” is not.
Which exports Binance itself provides
Two routes are available, and both have limits you should know about in advance — especially if several years need to be reconstructed.
Limits of the two export routes according to Binance Support, retrieved on 9 September 2026.
| What | Limit |
|---|---|
| Period per statement (spot history) | a maximum of one year from the selected date, data from 13 July 2017 |
| Statements per month (spot history) | five |
| Statements per month (general transaction history) | 15 to 40, depending on the account |
| Validity of the download link | seven days |
| Binance Tax: transactions covered | up to 100,000 |
| Binance Tax: not supported | futures and NFTs — to be added manually |
Why these figures add up
A case with eight open years needs eight statements. With five statements per month for the spot history, that is two months — for an account whose access is currently being wound down. If you only start when the voluntary disclosure (Selbstanzeige) is already urgent, you no longer have this window. And the download link expires after seven days: an export that nobody downloads in time has to be requested again and uses up a further allowance.
Typical pitfalls with Binance data
The most common misconception is that a single export reflects the whole case. That is rarely true for Binance, because activity is spread across several products and the export routes reach back to different extents.
- Futures and NFTs are missing from the in-house tax report. According to Binance, Binance Tax does not cover them; if you only provide this report, you are handing over an incomplete set of facts without realising it.
- The annual slices hide gaps. If you export each year separately, it is easy to overlook a year — especially one in which little happened. For the completeness of an amended return, that is precisely what is critical.
- The 100,000 limit affects active accounts. If you have traded for years with bots or frequent small amounts, you will exceed it sooner than you think — and then need a different route than the in-house report.
How raw data from several sources can be combined into a robust calculation is described in our article on crypto data preparation and tax reports (in German). The substantive basics — holding period, exemption limit (Freigrenze), FIFO, staking — are set out in the crypto tax guide.
What to do if earlier years have not been declared
Then the same sequence applies as in any other case — only under time pressure. First secure the data while access still exists. Then check which years are open and whether a voluntary disclosure under Section 371 of the German Fiscal Code (AO) is still possible. Not the other way round: an incomplete disclosure that has been filed forfeits exemption from punishment entirely.
The time pressure here comes from two directions. On one side, the grounds for exclusion (Sperrgründe) under Section 371(2) AO, which can arise as the tax authority’s knowledge progresses. On the other, the winding-down of an account whose data you need for precisely this disclosure.
Requirements, grounds for exclusion and the procedure are set out on our page on the crypto voluntary disclosure.
